Who can apply for the 2026 extraordinary regularization?

Adult foreign nationals who arrived in Spain before January 1st, 2026 and have been in the country continuously for at least 5 months without leaving the territory. Asylum seekers who filed their application before that date are also eligible. In all cases, having no criminal record is mandatory.

When can applications be filed and when does the window close?

The window opened on April 16th, 2026. It closes definitively on June 30th, 2026. Online filing is available 24/7. In-person appointments require prior booking.

What documents do I need to regularize in Spain?

You need: (1) a passport or other identity document, (2) evidence that you were in Spain before 1/1/2026 — plane ticket, rental contract, bills, medical records —, (3) evidence of 5 continuous months of presence, and (4) an official criminal record certificate from your country of origin and from every country you lived in during the past 5 years, legalized and translated.

What happens if I have a criminal record?

Active criminal records are grounds for automatic denial. However, if your record is cancellable — you already served your sentence and the Criminal Code expiration periods have passed — you can start the cancellation before filing. Each case requires urgent individual analysis.

Can I regularize if my asylum claim was denied or is pending?

Yes. If you filed your asylum application before January 1st, 2026, you can apply for regularization regardless of the state of your file. If you are granted regularization, you will need to withdraw the asylum claim to activate your residence card.

What permit do I get if my application is approved?

A one-year residence and work permit, renewable, valid across Spain and in any labor sector. It does not allow you to work in other EU countries. Minor children receive a special 5-year permit.

How long does the resolution take?

Acceptance of the application has immediate effects: you can work legally from that moment. A final resolution can take several months. In previous comparable processes, the average resolution took 6 to 8 months.

Can I file the application myself without a lawyer?

Yes, if you have a digital certificate and NIE you can file it through the Mercurio platform. However, documentation errors are the most frequent cause of requests for additional evidence and denials. A poorly prepared file can cost you months of waiting or outright exclusion.

Does regularization grant me Spanish citizenship?

Not directly. It grants you legal residence. However, the residence time counts towards future naturalization — 2 years for Ibero-American nationals, 10 for others. And the clock starts at application acceptance, not at resolution.

What if my application is denied?

You have the right to file an appeal before the Ministry of Inclusion. The deadline is 1 month from notification. Having legal representation during appeal is very important.
